Next weekend, we have Victorian State elections and Auction underquoting has been raised by the Liberal party. The Napthine Coalition, if elected, will introduce new laws addressing the hot issue with real estate agents, buyers and sellers.

The following changes will be implemented to offer more transparency to the market regarding the reserve and pricing structure:

  • All homes being sold at auction must include a listed price or price range when advertised
  • The reserve price of a home must be within the advertised price range
  • The difference between the low and high end of the price range must be a maximum of 10 per cent
  • A reserve price and price range must be included on a sales authority form signed between a vendor and agent
  • Reserve prices can be altered, but only up to three days before the auction and the public must be notified of the new price range via advertisements
  • Spot audits of agents will be done before auctions, as well as after
  • Agents face fines of up to $29,000 if they break the law
  • Consumer Affairs Victoria will have a dedicated hotline for complaints
